Mrs. Nguyen Thi Loan’s son, Ho Duy Hai is currently on death row for a crime that he didn’t commit. Hai was arrested and tried for the murders of two female post office employees, Nguyen Thi Thu Van and Nguyen Thi Anh Hong in 2008. He was tortured and coerced into a confession. There were signs that Ho Duy Hai was tortured. A note from the court sated “the amount of physical force was used on him to the point he could not walk, requiring someone on each side to help him move at the time attending the Appellate Court.” He wasn’t allowed to have an attorney during the interrogation”

Mrs. Loan has spent 10 years pleading her son’s innocence. She has filed over 1000 petitions to the appeal court but the court ignored all of them. She said Ho Duy Hai was not allowed to see his attorney since 2008.

Hai was a scapegoat for the real killer because the real killer is related to a rich and powerful family in Vietnam. There were witnesses but they were too afraid to testify.

Mrs. Loan made numerous trips to Hanoi pleading for her son’s life. “Please save my son” “My son is innocent”, begged the distraught mother with tears streaming down her face; it broke my heart when I saw her video; however the Vietnamese communist government didn’t listen or pay attention to her.

Finally she decided to come to Bangkok so she could meet with the UN and Amnesty International. It was not an easy trip for her. She was not allowed to get on the plane from Hanoi so she had to go back to Saigon and leave from there. We had to cancel and reschedule a few flights but she got a chance to share her story with the UN and Amnesty International. When I arranged the trip, I didn’t have money to buy the tickets and I couldn’t post on FB to ask for donations. Thanks to Ma Tieu Linh, she sent me the money immediately for Mrs. Loan’s trip. Thanks to another friend of mine has been helping Mrs. Loan but this person wants to stay anonymous. You know who you. Thanks to Viet Nguyen who helped me as soon as Mrs. Loan landed in Bangkok and translated for Mrs. Loan at AI and UN offices. Last but not least important, thanks to Chau Van Thi for interviewing Mrs. Loan. This is not one man operation.

I first heard about Ho Duy Hai’s case in 2015 from activist Tran Thi Nga. She contacted me and asked me to help. I contacted the UN officer and the officer told me it was a good case. That’s why I was confident to help Mrs. Loan to come to Bangkok.

I read the translated court reports and I believe Hai is innocent. These are a few examples:

“The finger prints were collected at the crime scene didn’t match Ho Duy Hai’s finger prints.

– The blood samples at crime scene weren’t collected until 5 months after the crime had occurred.

– No forensic analysis on the time of death of each victim.

– The inconsistencies in the statements of the accused had not been clarified and yet these statements were used as the primary basis for the conviction.

– The inconsistencies of evidences to use as murder weapons.

I don’t believe in death penalty because I think it is cruel and barbaric and I believe an individual’s right to life should be upheld.

Let us keep this mother and her son in our prayers and hope that justice will be served.
